Claimly Auto respects the intellectual-property rights of others. This policy explains how copyright owners or their authorized representatives may submit notices of claimed copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and how users may submit counter-notifications when material has been removed or disabled as a result of mistake or misidentification. Use of Claimly Auto, including content submitted through the service, is also subject to our Terms of Service and Acceptable Use & User Content terms.
If you believe material stored on or accessible through Claimly Auto infringes a copyright that you own or are authorized to enforce, you may submit a written DMCA notice to our Designated Copyright Agent. To be effective, the notice must include:
1. Your physical or electronic signature.
2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notice, you may provide a representative list of those works where permitted by law.
3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to allow Claimly Auto to locate the material.
4. Information reasonably sufficient to allow us to contact you, such as your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information contained in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Claimly Auto's Designated Copyright Agent information should correspond with the information maintained with the U.S. Copyright Office.
When Claimly Auto receives a notice that substantially complies with applicable DMCA requirements, we may remove or disable access to the material identified in the notice and take other actions appropriate under applicable law.
Where appropriate, we may notify the user who submitted the affected material and provide information regarding the counter-notification process described below.
Claimly Auto may request additional information if a notice does not contain information reasonably sufficient for us to identify the copyrighted work, locate the allegedly infringing material, verify the required statements, or contact the complaining party.
If material you submitted has been removed or disabled in response to a copyright notice and you believe the removal or restriction resulted from mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent. To be effective, a counter-notification must include:
1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, mailing address, and telephone number.
5. A statement that you consent to the jurisdiction of the appropriate United States federal district court for the judicial district in which your address is located or, if your address is outside the United States, a judicial district in which Claimly Auto may be found.
6. A statement that you will accept service of process from the person who submitted the original copyright notice or that person's agent.
If Claimly Auto receives a valid counter-notification, we may provide a copy to the person who submitted the original copyright complaint.
The complaining party may then have an opportunity under applicable law to notify Claimly Auto that it has filed a court action seeking to restrain the allegedly infringing activity.
Claimly Auto will handle restoration, continued restriction, or other treatment of the affected material in accordance with applicable law.
In appropriate circumstances, Claimly Auto may suspend or terminate users who repeatedly infringe copyrights or other intellectual-property rights.
Claimly Auto may consider the circumstances surrounding infringement complaints and account activity when applying this policy.
The DMCA may impose liability on a person who knowingly and materially misrepresents that material or activity is infringing or that material was removed or disabled by mistake or misidentification.
