The standard terms that govern each appointment of a Claimly Auto network appraiser under the Appointed Total Loss Appraiser service. A copy referencing your specific case is part of your service purchase.
By purchasing the Appointed Total Loss Appraiser service and completing the required acknowledgments, the policyholder appoints an independent certified appraiser from the Claimly Auto network (the “appointed appraiser”) to serve as the policyholder's appraiser under the appraisal provision of the policyholder's own automobile insurance policy, for the first-party total-loss valuation dispute identified in the purchase.
The appointed appraiser will independently determine the vehicle's actual cash value; review market comparables; exchange valuation evidence and methodology with the insurer's appraiser; seek agreement on the amount of loss; participate in umpire selection where the policy permits; participate in appraisal deliberations; and, where permitted, sign an appraisal award.
The appointed appraiser acts as an independent, impartial and — where the policy requires — disinterested appraiser. The appointed appraiser is not the policyholder's agent, attorney, or public adjuster, and nothing in this agreement requires the appraiser to reach any particular value.
The appointed appraiser will not provide legal advice, interpret insurance coverage, determine fault or liability, advise on accepting or rejecting any settlement, or address any matter other than the value of the vehicle.
The appointed appraiser is compensated by Claimly Auto on a flat, non-contingent basis. The policyholder owes the appraiser nothing directly, and no part of any compensation depends on the outcome of the appraisal.
The policyholder is responsible for invoking the appraisal provision, complying with the policy's requirements, and providing truthful, complete information and documents. The policy's language controls the appraisal process, and there is no guaranteed outcome.
The appointment ends when the appraisal concludes, the dispute is otherwise resolved, or either party terminates in accordance with the service terms. Claimly Auto may replace the appointed appraiser with another eligible network appraiser if the appointed appraiser becomes unavailable or ineligible (for example, a lapsed state license).
The limitation of liability, dispute-resolution, and governing-law provisions of the Claimly Auto Terms of Service apply to each appointment.
